Utilisation de la clause dérogatoire par l’Alberta: « C’est troublant », selon un expert

Le gouvernement de l’Alberta a de nouveau invoqué mardi la disposition de dérogation de la Charte afin de prévenir toute contestation judiciaire visant trois lois touchant les jeunes et les adultes transgenres. Il s’agit de la deuxième utilisation de cette clause en moins d’un mois par le gouvernement de Danielle Smith, qui affirme ne pas avoir d’autre option. Pour Frédéric Boily, professeur de science politique à l’Université de l’Alberta, il est préoccupant de voir la clause dérogatoire être employée à deux reprises en si peu de temps.
